Viscount Bennett Redevelopment Sparks Legal Pushback Amid Broader Rezoning Tensions

Opposition to one of Calgary’s major infill projects is heading to court. A group of 18 Richmond-Knob Hill residents has filed a judicial review challenging city council’s decision to rezone the former Viscount Bennett school site, where the Minto Group plans to build 1,509 units across eight buildings — some rising as high as 16 storeys — in a new community branded as Parkline.

 

The group alleges procedural missteps in the approval process, including reliance on outdated traffic data and insufficient infrastructure analysis. While the outcome may not ultimately halt the development, the group’s leaders argue it underscores broader frustration with how density decisions are being made in Calgary’s established neighbourhoods.

 

Legal experts note that a separate case — WestCan v. City of Calgary — could significantly impact the viability of future appeals. If the Supreme Court declines to hear WestCan, lower courts will be bound by the precedent, making it more difficult for residents to overturn planning approvals. Still, with court proceedings set for July 23, the Richmond-Knob Hill appeal may become a flashpoint in Calgary’s ongoing rezoning debate.

 

For CRE investors and developers, this case will be closely watched: a well-branded project backed by an experienced developer is facing entrenched community resistance — despite aligning with the city’s broader planning vision.
